About these terms
These terms are an agreement between PLAYNICELY PTY LTD, a company registered in South Africa ("PlayNicely", "we", "us"), and the company that buys Herding Cats (the "Customer"). They also apply to each person who uses Herding Cats with a seat (a "member"), in the parts written for members.
By buying Herding Cats, you confirm that you are authorised to agree to these terms for the Customer. By joining with a seat, a member agrees to the parts of these terms that apply to members and to our Privacy Policy.
What Herding Cats is
Herding Cats turns each member's CliftonStrengths® 34 results into a FITT16™ archetype and gives them AI tools for working with colleagues: Let's Chat, Emerging Patterns, Your Archetype Insights, My Colleagues, Pair Insights, the Agreement, Feedback and Conflict Navigators, 16 Archetypes, Let's Meet and Meeting Dynamics.
Herding Cats is for understanding, not for judging people. Archetypes are an interpretive framework, not a clinical, psychological or validated psychometric test. Herding Cats must not be used to decide whether to hire, promote, discipline, rate or dismiss anyone, or to rank or screen people.
Herding Cats is not a clinical, psychological or therapeutic service, and nothing in it is professional advice.
Company accounts and admins
- The person who buys sets up the company account and becomes its first admin. A company can have more than one admin.
- The buyer always takes one of the seats bought, which gives them the app and the admin dashboard.
- Admins send seats to colleagues and can withdraw an invitation that has not yet been accepted.
- Admins cannot see members' results or anything a member creates in the app. The Customer must not ask members to share their screens, reads or notes as a condition of work.
- The Customer is responsible for keeping admin sign-in details secure and for what its admins do.
Seats
- One seat is for one named person for the subscription year.
- Seats are sent to a person's work email address. Colleagues must share the same work email domain, and personal email providers are not accepted.
- Members join by invitation and never pay.
- If an invitation is withdrawn before it is accepted, the seat goes back to the Customer.
- Once a member has joined, the seat goes back to the Customer only if that member deletes their account. A seat cannot be moved from one person to another.
- Each member must have their own CliftonStrengths® 34 results, or take the assessment, to use the app fully.
Prices, billing and renewal
Herding Cats is billed yearly, per seat, at the price shown at checkout, in US dollars or, for companies in Southern Africa, in South African rand. Dodo Payments is the merchant of record: Dodo sells the seats, charges the Customer, issues invoices and adds any sales tax, VAT or GST due. We never see or store card details.
- Automatic renewal. The subscription renews each year for the same number of seats until it is cancelled. To stop a renewal, cancel at least 30 days before the renewal date.
- Adding seats. Seats can be added at any time. New seats are charged for the part of the year that is left, and the renewal date does not change.
- Regional pricing. A regional price is only for companies based in that country. If the billing country at checkout does not match the company's country, the regional price does not apply. If a company's country has been misstated, we may charge the difference or end the account. If the card's country does not match the billing country, we may review the account.
- CliftonStrengths® codes. Where a seat is sold with a CliftonStrengths® code or upgrade, the code is issued by Gallup and emailed within 1 hour of payment, and the assessment is taken on Gallup's site under Gallup's terms. The code is charged at the price shown at checkout and cannot be refunded once it has been issued.
- Volume pricing. For 51 seats or more, email us. Any separate agreement we sign with you takes priority over these terms where they differ.
- Refunds. Herding Cats is a digital service delivered as soon as a seat is available. Fees are not refundable, except where the law requires.
Using Herding Cats (members)
Members agree to:
- Give accurate information and be at least 16 years old
- Upload only CliftonStrengths® reports that belong to them
- Invite only colleagues they genuinely work with, and never send unwanted or misleading invitations
- Never use another person's archetype, reads or notes to harm, profile or disadvantage them
- Not use the AI tools to create content that is unlawful, abusive, sexually explicit, deceptive or harmful
- Not copy, scrape, reverse-engineer or resell the service or what it produces
Members own their personal data. They let us process it only to provide Herding Cats, as our Privacy Policy describes.
AI-generated content
Herding Cats uses Anthropic's Claude to write reads and to power Let's Chat. AI content can be incomplete or wrong. It offers possibilities and questions to consider, not facts about anyone, and it is not a substitute for professional advice. Nobody's content is used to train AI models.
No link with Gallup
Herding Cats is independent. It is not affiliated with, endorsed by or sponsored by Gallup, Inc. or Anthropic. CliftonStrengths® is a trademark of Gallup, Inc.
Intellectual property
Herding Cats, FITT16™, the archetypes, their names and descriptions, the frameworks, the software and the reads are the intellectual property of PLAYNICELY PTY LTD. Neither the Customer nor members may copy, republish or resell them, or use them to build a competing product. A member may share their own reads with others if they choose.
Confidentiality and data
We handle personal information as our Privacy Policy describes. The Customer does not receive members' personal content, and we will not provide it except where the law requires. Each party will keep the other's confidential business information private.
Cancelling, suspension and ending
- The Customer can cancel at any time, effective at the end of the current year, if it cancels at least 30 days before the renewal date.
- We may suspend or end access for a company or a member that breaks these terms, misuses the AI tools or colleague invitations, or tries to extract our intellectual property.
- When a subscription ends, members lose access to Herding Cats. Their account and any personal FITT16 access they hold separately are not affected, and they can delete their account at any time.
- Ending access does not give a right to a refund, except where the law requires.
Liability
We are not responsible for decisions made using Herding Cats, or for outcomes in anyone's work or relationships.
As far as the law allows, we are not liable for indirect or consequential loss, or for lost profit, business or opportunity. Our total liability to the Customer for any claim is limited to the fees the Customer paid for Herding Cats in the 12 months before the claim.
Herding Cats is provided "as is". Nothing in these terms limits a right that cannot be limited under the law that applies.
Governing law
These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction. People in other countries keep any rights their local law gives them, including data-protection and consumer rights, which these terms do not take away.
Changes to these terms
If we change these terms, we will update the date at the top of this page and tell admins by email before a significant change takes effect. A change to price takes effect at the next renewal.
